  1. TERMS AND CONDITIONS OF WEBSITE AND PURCHASE

2.1 This legal notice applies to the entire contents of our website as well as any e-mail correspondence between you and us. Please carefully read these terms and conditions before using this website. By using this website, you agree to these terms. Do not use this website if you do not agree to these terms. Moondreams Limited has issued this notice, and all references to ‘us,’ ‘we,’ or ‘our’ are to Moondreams Limited.

  1. DEFINITIONS

3.1 “Buyer” means the person who buys or agrees to buy the products/goods from the seller.

3.2 “Seller” means Moondreams Limited.

3.3 “Products” means those goods specified.

3.4 “Conditions” means the terms and conditions of sale set out in this document and any special terms and conditions agreed in writing by the seller.

3.5 “Consumer” shall bear the meaning in Section 12 Unfair Contract Terms Act 1977.

3.6″Delivery date”means the date set by the seller for when the products will be delivered to the buyer’s address.

3.7″Dispatch” means the date the product leaves the relevant warehouse.

3.8 “Delivery place” refers to the delivery address as specified by you, the buyer, when ordering.

3.9 “Order” refers to your offer to purchase products that you place with us, whether electronically or otherwise.

3.10 “Regulations” refers to the Consumer Protection (Distance Selling) Regulations 2000 (“The Buyers Right to Cancel”).

3.11 “Address” refers to the address for Moondreams Limited.

3.12 “Contract” refers to any Contract between the buyer and Moondreams Limited for the sale and purchase of products incorporating these conditions, whether completed electronically through this website or via other means.

  1. APPLICATIONS OF CONDITIONS

4.1 These terms and conditions supersede all other terms and conditions. Each order placed by the buyer is deemed to be an offer to purchase products from Moondreams Limited, the seller, subject to conditions. Each order placed by the buyer is deemed accepted by the seller and becomes binding when the seller issues a confirmation to the buyer or, if earlier, when the seller delivers the products to the buyer in accordance with the delivery terms and conditions.

4.2 There will be no binding contact between the two parties if for any reason the seller does not accept the buyers order.

4.3 To enable the seller to perform the Contract in accordance with these conditions, the buyer must ensure that the details provided by the buyer are complete and accurate, and that the buyer provides all necessary information relating to the supply of the products in a timely manner.

4.4 Any error or omission in the seller’s sales literature, price list, quotation and invoice, acceptance of offer, or other document or information shall be subject to correction without liability on the seller’s part.

4.5 If the seller is unable to supply the product and payment has already been made by the buyer, the buyer’s account will be refunded or re-credited with the amount paid by the buyer, subject to agreement between the seller and the buyer. The refund will be processed as soon as possible, and in any case within 7 days of the order. The seller is under no obligation to compensate for any disappointment. If any of these conditions is found to be invalid or unenforceable in whole or in part, the validity of the remaining provisions of these conditions and the remainder of those provisions in question is unaffected.

  1. DEFINITION OF SALE

5.1 There is no contract between the buyer and the seller for the sale of any products until the seller receives, processes, and confirms the order and receives part or full payment. When the seller receives partial or full payment, a legally binding contract is formed between the buyer and seller.

5.2 Any advertising or specifications issued by the seller, as well as any illustrations or descriptions on our website, will not form part of any Contract. Such information is provided solely for illustration or guidance purposes and may have no bearing on products.

5.3 The seller may assign the Contract or any part of it to any person or company.

5.4 Without prior written consent, the buyer shall not be permitted to assign the Contract or any part of it.

  1. PRICE AND PAYMENT

6.1 The listed price includes VAT (value added tax) at the standard rate in the United Kingdom. Your printed order confirmation will show the correct price you will pay. Prior to delivery, all orders must be paid in full.

6.2 The listed price includes V.A.T. (value added tax) at the UK standard rate. The correct price will be shown on your printed order confirmation. All orders must be paid in full prior to delivery.

6.3 We accept Visa, Delta, MasterCard, Switch, Maestro, and Solo credit/debit cards, but not American Express or Diners Club. To purchase product(s) on our website or over the phone, you must confirm that the credit or debit card being used is yours. The card issuer conducts validation and authorization checks on all credit/debit card holders. If the issuer of your payment card refuses to or does not authorise payment to us for any reason, we may cancel our Contract with you.

6.4 Orders must be processed and approved by our Payment Provider as well as any other security checks by 12pm for next day delivery.

  1. ACCURACY OF PRODUCT INFORMATION AND DESCRIPTION OF GOODS

7.1 Moondreams Limited has made all product images, specifications, and other information available on our website. The goal is for all of the information on the website to be as accurate and up to date as possible. However, while we will use reasonable efforts to verify the accuracy of any information we post on the website, we make no express or implied warranties about its accuracy.

7.2 You, the buyer, agree that any colour appearing on the website is not necessarily an accurate representation of the colour it purports to depict due to the computer system. All actions taken by the buyer on the website are the buyer’s responsibility.

7.3 All product descriptions will be as accurate as possible; sizes are approximate and are standard UK sizes. Remember that bed frames are always larger than the mattress that fits inside them (taking into account the thickeness of the frame, side rails etc). Please contact us if you require information on unusual sizes.

  1. GUARANTEES AND FAULTY GOODS

8.1All goods are warranted for a period of twelve months from the date of delivery against defects in materials and workmanship. Complaints about faulty goods should be made in writing to Moondreams Limited, Unit 2, Myrtle Street, Bradford BD3 9TN, within seven days of the fault becoming apparent.

8.2 In the unlikely event that goods develop a manufacturing fault, the seller reserves the right to have the goods repaired or replaced at its discretion, and any delivery costs associated with the exchange of faulty goods will be borne by the seller unless the goods were collected by the buyer.

8.3 The repair turnaround time is determined by the current workload of the relevant manufacturer. We will not accept any claims for losses incurred during this time period.

8.4 When goods are reported as faulty, we reserve the right to arrange an inspection; if the goods are found to be not faulty on inspection, but the result, for example, of:

fair wear and tear, exposing the product(s) to excessive wear and tear, e.g. jumping on the mattress(es), standing on a frame use without bed linen

Customer abuse by using the product(s) with a base for which it was not designed or by failing to follow the seller’s recommendations

Incorrectly assembled product(s) rolling or bending negligence or wilful damage overloading any drawers and causing distortion of the base

The seller then retains the right to charge a minimum of £80 for the inspection in order to cover its costs as well as travel expenses. This fee will be agreed upon and paid for prior to any inspection, and if an item is found to be faulty, the buyer will be refunded the purchase price of the faulty product within seven days of the inspection.

8.5 When more than one item is purchased at the same time on the same order, no other part of the order will be refunded.

8.6 If the product is damaged as a result of any of the examples in 8.4, the guarantee is null and void, and you will not be entitled to a replacement product, part, or refund.

8.7 The buyer and seller must both agree to be bound by the inspection results.

YOUR STATUTORY RIGHTS ARE NOT AFFECTED

  1. REFUNDS

9.1 Refunds on goods cancelled prior to delivery or despatch will be made as soon as possible following written cancellation notification from the buyer and, in any case, will not exceed a period of 7 days before the delivery date. All refunds will be issued to the same credit card that was used to make the original purchase. Refunds on goods already delivered will be made as soon as possible after collection, return, and inspection of such goods, and will in no case exceed 30 days after collection/return.

9.2 If an item has already been shipped or delivered, a fixed £50 fee will be charged to cover the cost of the original delivery fee, as well as a return and collection fee of £1 per running mile back to the main Swindon, Wiltshire warehouse. For example, if the original delivery fee was £25 and the delivery distance was 10 miles, the return fee would be £25 plus £20. As a result, the total would be £45. This sum will be deducted from any refund.

  1. CANCELLATIONS

10.1 The buyer has the right to cancel within seven days under Regulations, unless the product(s) has been specially made, sold business to business, or the buyer has subjected a product(s) to one or more of the examples in 8.4, or has failed to comply with 10.4.

10.2 Please keep in mind that you do not have the right to return an item if you have changed your mind or no longer require it. This is due, in part, to concerns about health and hygiene. Here are a few examples:

flat pack furniture, opened bed frames, partially or completely assembled mattresses, sofabeds, divans, headboards, pillows, duvets, mattress protectors

10.3 It is the buyer’s responsibility to ensure that the item(s) purchased meet their requirements. Some examples include size, suitability, colour, feel, appearance, description, and price. In such or similar circumstances, the seller is unable to provide a refund.

10.4 You must take reasonable care of the items. Please return an item in its original, unopened, and undamaged packaging, including all components. If an item is returned unopened, undamaged, and in its original, undamaged packaging, and is re-saleable, we will issue a refund in accordance with our refund policy (see point 9.1 & 9.2).

10.5 You must inspect your product(s) upon delivery, and if you find them to be faulty or damaged and report the alleged fault or damage within 24 hours of receipt, we will either exchange the product(s) or offer a full refund within 14 days of delivery. In such cases, provided that the product(s) are adequately wrapped and do not violate sections 8.4 and 10.2.

10.6 You will be entirely responsible for arranging and paying for the return of the goods (see 9.1 & 9.2). On request, we can provide a quote for the return of the item(s) using our own vehicle or a haulage company of our choice.

10.7 Goods returned incomplete, damaged, or in any condition other than sellable as new will be returned to the buyer, and the buyer will be responsible for the cost of return carriage before we arrange the return of the goods to the buyer.

10.8 Any product that has been opened will not be accepted back.

10.9 If you do not return an item after our reasonable attempts to recover it, you will be deemed to have accepted the item.

10.10 Your statutory rights are not affected.

  1. RETURNS

11.1 If the buyer does not want Moondreamst to arrange for the safe return of items to us, you can make your own arrangements at your own expense for the carriage and return of the product(s) to us.

11.2 Please notify us if you are arranging the return yourself.

11.3 Please ensure that these product(s) are properly wrapped and in their original packaging. You will be responsible for the product(s) until they are received by us, at which point we will refund payment, provided that the product(s) are received by us undamaged.

11.4 You must take reasonable care of the items. Please return an item in its original, unopened, and undamaged packaging, including all components. If an item is returned unopened, undamaged, and in its original and undamaged packaging, and is re-saleable, we will issue a refund in accordance with our refund policy (see point 9.1 & 9.2).

  1. AVAILABILITY OF GOODS

12.1 All services and products are limited in supply and may be discontinued at any time. If we do not supply the ordered goods, we will refund any money already paid (please note that if we have made the delivery and the buyer is not at the delivery address during the agreed date and time, it will be considered that we have supplied the order). We will not be responsible for compensating you for any other losses you may suffer if we do not supply the goods.

  1. DELIVERY CHARGES

14.1 All of the prices on our website include delivery. We offer free delivery to most mainland addresses, but we reserve the right to charge any congestion charge, parking fee, or road toll required to deliver to your property. Delivery is always made to the property’s main entrance on the ground floor.

14.2 The delivery fees quoted on this website (including free delivery) do not apply to any of the following postcodes: IV, HS, KA27-28, KW, PA20-49, PA60-78, PH17-26, PH30-44, ZE, BT, IM, TR21-25, or any offshore addresses.

  1. DELIVERY TIMES

15.1 We will always make every effort to deliver goods on time, but goods are subject to availability, and delays in delivery are sometimes beyond our control. Any dates and times specified for the delivery of the goods are only estimates, and we will not be liable for any losses, costs, charges, damages, or expenses incurred as a result of any delay in the delivery of the goods. Furthermore, time shall not be of the essence of the order and shall not form part of the contract.

Our standard delivery hours are 8 a.m. to 6 p.m. Please ensure that you are at the address where the goods will be delivered.

15.2 Such delays could be caused by, but are not limited to:

Holiday seasons, such as Christmas and Easter

Inaccessibility, such as restricted access to a property, security measures, road closures, narrow roads, or driveways The buyer must assume that the delivery vehicle is roughly the size of a refuse truck.

The buyer provided incorrect information.

Unforeseen circumstances, including but not limited to lock-outs, strikes, riots, malicious damage, labour disturbances, trade disputes, government action (including action by any local or statutory authority), fire, floods, vehicle breakdown, acts of God, supplier delays, or any other cause beyond the sellers’ control.

15.3 Where possible, the seller will always attempt to contact the buyer in advance to inform them of such circumstances. It is the buyer’s responsibility to notify the seller of any access or delivery restrictions at the time of purchase so that reasonable steps can be taken prior to delivery.

15.3 If there are circumstances that the seller is not aware of, and that subsequently the seller is unable to deliver the goods successfully then the seller will ‘Fail’ the delivery (see Section 16 below).

15.4 The driver cannot offer assistance of assembly of beds.

15.5 The delivery vehicle will most likely be a long, heavy goods vehicle weighing approximately 7.5 tonnes and standing 14′ 3″ tall (Typical size of a dustbin lorry). As a result, it is your responsibility to ensure that such a vehicle can legally access your property and to notify us of any weight, height, or parking restrictions, as well as any difficult access points or unadopted roads/paths. This will assist us in delivering your order and ensuring that the appropriate size of delivery vehicle is used.

If you do not provide us with this information, your delivery may not be completed, and you will be charged a £25 aborted delivery fee.

  1. FAILED DELIVERY

16.1 If the buyer:

  1. a) fails to provide us with adequate delivery instructions and/or fails to notify us of errors in the order acknowledgement and/or order confirmation relating to the delivery address details
  2. b) fails to notify us that the agreed-upon delivery date is inconvenient, and as a result, you fail to accept delivery of the good(s) whenever delivery is attempted

Then, without limiting any other right or remedy available to us, we reserve the right and will seek to recover all transportation costs for the return trip back to the main warehouse, as well as any re-delivery fee as set out in 9.2.

  1. RE-DELIVERY

17.1 The seller can arrange a re-delivery of the product to the buyer The cost of any re-delivery will need to be paid in full by the buyer before dispatch, as shown in 9.2.

17.2 The cost of the return delivery, re-delivery or admin fee will need to be paid for in full by the buyer before the product(s) are dispatched again.

17.3 Product(s) will remain the responsibility of you the customer until they are re-delivered to your address.

  1. RESPONSIBILITY FOR GOODS

18.1 You will be responsible for the goods as soon as we deliver them to your door. We will only deliver goods to the address on the order, and goods will not be left without a signature or at an alternative address. Any loss or damage to the goods will be at your own risk from the time of receipted delivery. Any transit damage to the goods, shortages, or incorrect goods supplied must be noted on the delivery consignment note at the time of delivery.

  1. LIMITATION OF LIABILITY

19.1 The seller’s total liability arising in connection with the performance or contemplated performance of this agreement, whether in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution, or otherwise, shall be limited to the price paid for the products.

19.2 Nothing in these conditions excludes or limits the liability of the seller for death or personal injury caused by the seller’s negligence or fraudulent misrepresentation.

19.3 The seller shall not be liable to the buyer for any indirect or consequential loss or damage (whether for loss of profit, loss of business, depletion of goodwill, or otherwise), costs, expenses, or other claims for consequential compensation arising out of or in connection with this agreement (however caused).

  1. COMPLAINTS AND DISPUTES

20.1 If the buyer has a complaint about the goods or service, the buyer should contact Moondreams, the seller by:-

YOUR SECURITY

When you make a purchase from this website, you agree that we may use the personal information you provide to conduct appropriate anti-fraud checks. Your personal information may be disclosed to a credit reference or fraud prevention agency, which may keep a record of it.

We will validate your name, address, and other personal information supplied by you during the order process against appropriate third party databases to ensure that your credit, debit, or charge card is not used without your permission. By accepting these terms and conditions, you agree to such checks. Personal information provided by you may be disclosed to a registered Credit Reference Agency during the course of these checks, which may keep a record of that information. You can be confident that this is only done to confirm your identity, that no credit check is performed, and that your credit rating will be unaffected. All information you provide will be handled safely and strictly in accordance with the Data Protection Act of 1998.
